Are you considering purchasing land in Uttarakhand for agricultural or horticultural purposes? Hold on! Before you take the leap, there’s something you need to know. Chief Minister Pushkar Singh Dhami and the Uttarakhand government have rolled out a temporary measure to safeguard the state’s precious agricultural and horticultural lands. Do you know what does this mean for you as a buyer?

It’s crucial to understand the ins and outs of land ownership regulations in Uttarakhand, especially for non-residents. That’s where the ‘Bhu Kanoon Act’ comes into play. In this article, we’ll walk you through the key provisions of this act and shed light on the special permissions required for land purchases in Uttarakhand.

Are you a non-Uttarakhandi interested in purchasing land in Uttarakhand? Then this is a must-read.

What is bhu Kanoon?

“Bhu-kanoon” is a Hindi term that translates to “Land Law” in English. In the context provided, it refers to a legal framework or legislation enacted in the Indian state of Uttarakhand. This law is designed to regulate the ownership, sale, and purchase of land in the hilly regions of Uttarakhand, with the aim of protecting the interests of local residents and indigenous communities. Bhukanoon typically includes provisions that may restrict or regulate the acquisition of land by outsiders or non-residents, often through mechanisms such as land use regulations, zoning laws, or restrictions on land transfers.

Uttarakhand land buying rules for outsiders

Back in 2003, the government made a change allowing people from outside to buy land in hilly areas, but only a small amount, like 500 square meters. Later, they reduced this to 250 square meters to stop big land deals in hill districts.

Then, in 2017, the government removed all these limits to encourage investments. They made changes to the UP Zamindari Abolition and Land Reforms Act, of 1950. This meant people could now buy more land, up to 30 acres, for things like tourism, energy, industry, agriculture, and horticulture.

But now, there’s a call to bring back restrictions. Some want the limit for land buying in towns to be 250 square meters, and they also want a complete ban on land sales in rural areas.

Key Provision Of the Bhu Kanoon

  • People from outside Uttarakhand usually can’t buy farmland or get residential land bigger than 250 square meters. But there are some exceptions, like for schools or government plans, they can take permission from higher authorities.
  • Non-residents generally cannot buy land in Uttarakhand, except if they have resided in the state for a minimum of 15 years.
  • Land is classified into various zones by the law, including agricultural, residential, and commercial zones. Transitioning land from one zone to another requires obtaining specific permissions to ensure responsible development practices. Documentation and registration with the relevant authorities are obligatory for all land transactions.
